Aphy App Store Terms and Conditions

These Terms & Conditions (“Terms”) explain how you may use the APHY App Store (“Aphy Apps”). Aphy Apps is available only on compatible devices with an active AphyOS subscription (“Subscription”). By accessing or installing apps from Aphy Apps, you accept these Terms. If you do not agree, please do not use the App Store.

1. About Aphy Apps

Aphy Apps is operated by Apostrophy AG, registered in Switzerland and located at Via Losanna, 4, 6900 Lugano (“Apostrophy”, “we” or “us”). You can contact us at support@apostrophy.ch for general help or for security matters.

Aphy Apps provides two types of applications: (i) apps developed by our company, and (ii) apps developed by selected partner developers. Aphy Apps is not publicly accessible and can only be used by active subscribers.

2. Who can use Aphy Apps

To use Aphy Apps, you need a compatible device, an active Subscription, and you must use the service for lawful purposes. You must be at least 16 years old, unless a higher minimum age is required in your country. Subscription conditions are covered in separate terms.

3. Apps availability and updates

Apps in the APHY App Store may change or evolve over time as we improve performance, add features, or maintain security. For safety and compliance with security rules, some updates —especially security patches — may be installed automatically and cannot be turned off.

We may also remove or discontinue apps if they pose a security, privacy, or legal risk, if they are no longer supported, or if they no longer meet our quality standards. When possible, we will inform you when an app is removed or discontinued.

4. Partner Apps

Some apps are created by approved partner developers. Before these apps become available, they are checked for security, malware, privacy handling, and general quality. Although we review these apps, the partner developers are responsible for their content, performance, and any personal data processed within their apps. Each app’s detail page shows the developer name and privacy information.

5. Your responsibilities

You agree to use the Aphy Apps and its apps responsibly. This means using them only on authorised devices, not attempting to interfere with or bypass security protections, and not installing or distributing apps outside the App Store unless your device or local law permits it. You must also respect copyright and licensing terms for every app you install.

6. Safety, Security and Privacy

We maintain strong security standards to protect users. All apps must follow our rules for safe updates, data protection, vulnerability reporting, and cybersecurity practices.

Your personal data is handled in accordance with our Data Protection Policy, which you can find at https://www.apostrophy.ch/data-protection-policy.

Some apps may ask for access to information or features on your device, such as the camera or contacts. These permissions will be shown to you before installation.

7. Reporting security issues

We operate a Coordinated Vulnerability Disclosure (CVD) programme. If you discover a security issue, you may report it to support@apostrophy.ch. We will acknowledge your report, work with you in good faith, and fix confirmed issues as quickly as possible. More information about our CVD process is available upon request.

8. Intellectual Property

All apps, trademarks, and related materials are owned by the respective creators. When you install an app, you receive a personal and revocable licence to use it on authorised devices. This licence cannot be transferred to others.

9. Open-Source Components

Some apps of Aphy Apps, as well as some apps and parts of the operating system or related services, may include open-source software components (“Open Source Components”). These components are provided under their own licence terms. The relevant licence texts, copyright notices, and source-code access (where required) are made available to you in the Open Source Notice section of the device settings, on our website, or inside the app that uses them.

Where an app or system component uses Open Source Components, those components remain governed by their respective open-source licences. Nothing in these Terms limits your rights granted under those licences. If there is ever a conflict between these Terms and an open-source licence that applies to a specific component, the open-source licence prevails for that component.

If an open-source licence requires us to provide source code, you may request it by contacting support@apostrophy.ch, and we will make it available in accordance with the licence conditions. You may use, modify, and redistribute the relevant Open Source Components as permitted by their respective licences.

Use of open-source software within partner apps is the sole responsibility of the partner developer. The developer is required to provide the correct licence information and any required source-code access within the app or its documentation.

10. Prohibited use

You may not attempt to access the Aphy Apps without a valid Subscription, distribute apps outside the Aphy Apps, use apps for illegal activities, or attempt to compromise Aphy Apps’ security. If you misuse the service, we may suspend or terminate your access.

11. Changes and maintenance

We may update or modify Aphy Apps at any time. This may include adding or removing features or performing maintenance. When appropriate, we will try to provide reasonable notice.

12. Liability

As far as permitted by law, Aphy Apps is provided “as is.” We are not responsible for indirect or consequential losses. Our total liability is limited to the amount you paid for your Subscription during the previous 12 months. Nothing in these Terms affects your rights under applicable consumer protection laws.

13. Ending your access

We may suspend or end your access to Aphy Apps if your Subscription expires, if you violate these Terms, or if your actions create a security risk. After your access ends, some apps may no longer function.

14. Governing Law and Disputes

These Terms are governed by Swiss law, except where mandatory consumer protection rules in your country apply. If you have a dispute, you may contact our support team, use the European Online Dispute Resolution (ODR) platform if you reside in the EU, or bring the matter before your local consumer court.

15. Changes to these Terms

We may update these Terms from time to time. Changes may be communicated in Aphy Apps, on our website, or through device notifications. If you continue using Aphy Apps after changes take effect, you are considered to have accepted the updated Terms.
